I get the ford report every week. Furby "Dale Ford" has a lot of insider information, thru his extensive paintball connections.

"H&K, the firearms people have initiated a slate of lawsuits against other firearms manufacturers, KEE Action Sports, BT Designs, Tippmann, and a bunch of Airsoft manufacturers."

Not sure on what grounds Kee would look to take on H&K,
but I can tell you from first hand experience that it's not
actually H&K that's bringing these actions, but a firm who
they've retained. This firm, which has a long track record
of going after firms who've copied something which another
firm holds the rights to, is like a shark at a labor Day beach
party when it comes to winning the suits it brings. The
only thing which helped in the case I was involved with
was the fact that H&K itself realized that it had been
supportive of the efforts which were made by the firm I
was asked to help. The result still left the firm with no
recourse but to stop offering the product and in return
H&K called off their dogs, but that was it.

I suspect the firms this company are now focused on
are in their sights because either they used the H&K logo
(mostly AirSoft firms), or some aspect of their design
and that includes things like just the 'look' of an H&K
product. Does this mean they've got a real beef to
go after these folks, only a court can decide that and
unless these firms have VERY, VERY deep pockets
and even if they do, they're going to get burned, one
way or th other.

Can anyone tell me how many Tippmann, Smart
Parts or BT models are out there on the streets with
an H&K 'style' cocking system, or look? Multiply that
number times whatever the court demands, plus of
course attorney fees and you begin to see the size
of the prize these guys are going after, as they're
probably working for a percentage, plus costs of
course.

Sincerely,
